As the owner of a franchise business, you should be aware that your franchisor has the right to terminate your franchise agreements with them if you are not living up to business expectations. There are a few different reasons why they can from failing to meet the sales quota or to offering poor quality products and services. Each year a great deal of franchisees lose their businesses because of not performing up to company standards.

Franchisers generally can choose the parties they wish to do business with and use their own business sense and judgment when entering into a new franchise relationship. Once yoru franchise agreement timeline is about to expire, you'll have the chance to your rights renewed. This is done with the franchisor during a negotiating session. If the franchisor feels that you failed to comply with the agreements in the contract, don't expect to be pleased with the prospect of having you continue on with the arrangement.


  • Know all of the important aspects and responsibilities in your franchise agreement so will be conducting business well and within the standards of the contract you signed. Read through the document carefully and thoroughly before signing it. If there are any issues or parts of the agreement that you do not fully understand, set up a meeting to discuss it with the franchisor and an attorney.
  • One great way to enhance your franchisor's confidence in your business abilities is to pay all of the royalty fees and monetary dues on time and in full. There is a much better chance of a franchisor keeping your business around if they believe you are responsible.
  • Try to find a marketing consultant who can help you increase name recognition and quarterly sales. By showing your franchisor that you are a successful and organized business person, they should have no reason to terminate your franchise agreement with them.
  • Take the time to go over your state's franchise rules so can become familiar with your own rights. There are a number of states with laws outlining the rights of franchisees in regards to terminated franchise agreements. Your franchisor would have a terribly difficult time terminating your contract as long as you are running your business in accordance with these laws.
  • Take care though since there are also some states with clauses giving franchisors the right to terminate a franchise agreement for a "good reason." I have seen reasons ranging from poor performance standards or deliberate disregard of the franchise agreements.
  • If a franchisor terminates your business relationship, the best thing for you to do is to immediately contact your franchise attorney to determine your rights and whether the franchisor's claims are valid. Once a franchisor terminates your contract agreement, it can take anywhere from 6 months to 1 year before a legal decision is made.
  • Although you are technically considered to be a business owner, franchisee owners still must follow the rules of the franchisor. If you don't, you can possibly lose all rights to their business and have no legal recourse to recover the investment.
